Colorado passengers injured in rideshare accidents can be covered by the rideshare company’s or the driver’s insurance.

Rideshare company insurance: If the driver is logged into the app, company coverage includes up to $50,000 per person or $1 million if transporting passengers.

The driver’s insurance: If the driver isn't logged into the app, their insurance applies. 

Other driver’s insurance: If another driver is at fault, passengers can file a claim against that driver’s insurance.

If you’re the passenger in a rideshare vehicle accident, you’re most likely not at fault. Your own insurance provider should not have to get involved.

The compensation you can receive from a Colorado Uber or Lyft accident depends on the driver's status. If you are a passenger or pedestrian injured by an on-duty rideshare driver, you can recover up to $1 million. Pedestrians waiting for ride requests and hit by drivers can recover up to $125,000. The driver's insurance covers $50,000 per person for bodily injury and $25,000 for property damage. 

If the driver wasn't on duty, their personal insurance pays. The law treats this as a normal car accident.

In Colorado, at-fault drivers must pay for accident-related losses and medical costs. Lawyers can check electronic records to verify if the driver was logged into the app. If the at-fault driver was working, you can claim against their company's insurance.

In Colorado, at-fault drivers must compensate injured parties. However, if drivers share equal blame, neither can claim damages.

This is called comparative fault. Drivers who are more than 50 percent at fault can't receive compensation. Those less than 50 percent at fault have their compensation reduced by their fault percentage. 

Let’s say you’re speeding through an intersection and collide with another driver who didn’t stop at the red light. You’re determined to be 30 percent at fault. Therefore, your $42,000 compensation is reduced to $24,500.
