I was sold a mobile home, that the company was legally required to completely replace the entire plumbing and electrical systems and bring them up to code before they could sell the home to anyone. They had their own property inspector which I was forced to use, and not allowed the option of a second opinion, or the knowledge that I "could" hire my own inspector. Instead, they had their inspector lie in his report and say everything was functional and worth the asking price. I also had to pay for his fraudulent services. I only recently found out about this when I had a contracting company come out to give me an estimate to fix my kitchen garbage disposal. Q the contractor told me that the plumbing and electrical systems were what too old, out of code and illegal, that the bad wires and leaky pipes were very dangerous, and that the place that sold me the home was legally required to replace everything and bring it up to code, and safe for inhabitants, before they could legally sell it to anyone. He said I need to find a lawyer and sue them , and make them replace everything and bring it up to code like they were legally required to do, and pay for all expenses for repairs made. Now, I need a good lawyer who can handle this and sue them for me.

It sounds like you’re looking for an attorney who specializes in real estate litigation to help you find a satisfying resolution to this mess, which makes sense. You were sold a mobile home with serious mechanical and system defects that your seller’s contractor failed to disclose to you.

Based on the initial details you’ve provided, the seller could be liable for failing to comply with safety, habitability, and failure to disclose laws, coupled with the fraudulent act of concealing those dangerous defects through a falsified inspection. I suspect this gives you strong grounds for claims like:

  • Breach of contract

  • Breach of warranty of habitability

  • Failure to disclose a material defect

  • Contractor fraud

  • Consumer protection violations

You were right to reach out to us. This is a high-stakes civil litigation matter that requires someone who knows the specialized rules of mobile home sales, can prove intentional fraud, and is prepared to guide you through high-stakes litigation to maximize your financial recovery.

Some of the state statutes your seller has allegedly violated have strict deadlines for filing claims that an experienced attorney can ensure are met. Because this case involves multiple bad actors, you need an attorney with the foresight to include every potentially liable partner and ensure they’re properly served. If the case ends up at trial,  it’s valuable to have a strong litigator with industry knowledge who can secure expert witnesses who can accurately and fairly value your claim before the court.

I encourage you to book a consultation with a member of our Real Estate Team at your earliest convenience. Between our main service and subservice areas, our team is well-equipped to fight for the compensation you’re owed, so that you’re able to enjoy living in your new home without any of the defects.
