question iconI had a contractor who not only did a bad job but got paid for work that he didnt do and didnt disclose it. Do I have to allow him to try and fix the problems or can I go to another contractor and and ask the original contractor to pay for it by whatever means necessary, meaning suing if needed?

Unfortunately, this is not an unusual scenario. The specific answer will require a review of your contract. If there is no written contract then in general you should give the contractor an opportunity to perform "warranty repairs." But, there are some factual scenarios where a court may agree that you do not owe the bad contractor an opportunity to repair before hiring someone else and charging to the original contractor.
