Your Legal Questions Answered

question iconHi, my HOA is telling homeowners that they can enforce a request that homeowners replace their interior pipes to copper if they are not already. This applies to all homeowners regardless of whether they have plumbing issues or not. Is this correct? I’m under the impression that the HOA cannot make a homeowner do any repairs or upgrades inside of their homes. Thanks so much!

Unfortunately, most issues which involve HOA making demands on Homeowners can only be answered based on a through review of the HOA covenants and by-laws. Generally, I think you are correct WRT the HOAs lack of power to force the Homeowner to make changes to personally owned property. But, it is possible that your HOA does have this authority. The best way to get resolution is to schedule a case assessment with one of our Homeowner attorneys. You can schedule a case assessment 24/7 by calling 303-688-0944 or online here. At your appointment, we’ll meet by phone or video (Zoom), we’ll discuss the facts, defenses, concerns, desired results, rights, remedies, the law, the process, timeline, how we can help, costs, etc.
