question iconWhat are my rights as an unmarried mother in Colorado? From my understanding I have sole custody. We did establish paternity and the fathers name is on the birth certificate. Would I be allowed to move out of state with my child?

Hello. I would need to see at least the Order that established Paternity if not other related Orders in the Paternity case you mentioned in the query to advise you with respect to your right to relocate the minor child. Typically there are still restrictions on relocation to a place where the current parenting time arrangements would be impossible, even if you have most all the parenting time and 100% sole decision-making authority. Please feel free to schedule an assessment with one of our family law attorneys to assist you with this concern. The warning I provide is that if without agreement of the other parent and approval by the Court, you move the child's primary residence to a geographical location that changes the relationship between the child and the other parent, you could lose your role as the overwhelming primary custodian. We just need to be sure that someone has reviewed and advised you specifically on the Orders you have over your child and related parental responsibilities.
