Getting back overpaid child support payments in Colorado can be tricky. The main challenge is that Colorado courts generally won’t refund child support that’s already come due. That said, there are a couple of options you may be able to pursue depending on the circumstances of your case.
You could ask the court for a credit toward future payments or a direct reimbursement from the recipient. A family law attorney can help with this because a judge can easily deny this request if the reduction of current support is not in your child’s best interests, which is the biggest factor the court will consider in assessing your request.
You could also ask the court to retroactively modify your support order if there has been a substantive change in custody. For example, if your child now lives with you all the time, but the old support order is still in place.
