question iconMechanic’s lien recorded (without any affidavit of NOI) 3 mo after end of work on house; now 8 mo past last work, no cure of defective lien nor any action, lis penden or foreclosure. As per 38-22-110 lien is invalid, has been for 2 months. How simplest to now get discharged’ as per 38-22-132?

If the lien is legally unenforcible as you state then you have nothing to worry about, it will remain of public record but have no consequence. If you wish to dispute the validity of the lien often times this requires a quite title action.
