Your Legal Questions Answered

question iconWe were recently cited for posting a sign (We believe, Be kind to all, BLM, Love is love, ) in our front yard. Per the HOA agreement only political signs are permitted and only 45 days prior to an election. I responded to them stating that we will adhere to the 45 day rule per C.R.S. 38-333-106.5 but we would be re-posting it in mid September. They have since responded that “political signs” are limited to consolidates only and that we cannot post our sign. I would love some clarification if an HOA can make this assessment on what constitutes a “political sign” or if we have legal backing for putting the sign back out in yard.

In order to assess your rights WRT the HOA demands we'll need to review your HOA Covenants and By-Laws as each HOA's rules are slightly different. Nevertheless, a strong Demand Letter from an attorney may resolve this for you. I recommend contacting our attorneys to schedule a case assessment at 303-688-0944 (24/7) or schedule online at https://calendly.com/case-assessment/case-assessment.
