Can a partition court rule or over ride an agreement that is already in place from a divorce?
The answer here unfortunately is, it depends. There are a lot of factual issues that need to be discussed like, why not go back to the Divorce Court that issued the decree, what creates the need and right to a partition action, how recently was the divorce finalized?
