Security Disposition resolution is needed. The tenants are going through a divorce and cannot agree on who is entitled to the security deposit. I have only been given a forwarding address for the wife. I have the husband's attorney contacting me with wanting her client to receive half the deposit. Both tenants are on the lease. How do I go about dispursing this money?

First, examine your lease agreement to determine if it addresses disputes between tenants. If it doesn't, the most secure approach would be to obtain a court order directing the distribution of the funds. You can either file a motion in the existing case or ask the attorney to provide a court order. Alternatively, you can seek a written agreement from both parties outlining the division of the security deposit. I recommend you speak with an attorney. If you would like to speak to one of our attorneys to discuss this, please contact us at (303) 688-0944.
