Your Legal Questions Answered

question iconMy HOA Board is now requiring any person who wants to run for the board submit their name a month before annual meeting and submit to a background and credit check for them to consider. Is this legal? From what I have found they can make reasonable qualifications such as no felonies but can they just “look over” like they compared it to a job application and then determine if I am qualified?

As each HOA's covenants and bylaws are unique it is impossible to fully answer your question. But, generally speaking, I suspect that your HOA is attempting to make demands for which it does not have the legal authority to enforce. If you are concerned about this I recommend that you schedule a case assessment with one of our attorneys to discuss your rights, remedies, risks, and options. You can schedule 24/7 by calling 303-688-0944 or at https://calendly.com/case-assessment/case-assessment
