HOA Board and selective enforcement

I built a parking pad at the end of my driveway in what was bar ditch some 22 years ago. My truck has been parked there for at least 5 consecutive years and this winter the HOA told me it had to go? a board member does the same thing but mine has to go because of a complaint from someone up the street. Do I have any recourse?

It is possible that the HOA has waived its right to enforce that specific covenant based on the duration of the violation (if there is one).
As such, I recommend that you contact us to have a conversation with one of our attorneys where we can understand the facts better, explain your rights, possible remedies, and offer some options to assist you.
