Thank you for reaching out. Based on what you described, your mother’s email cancellation the day after signing was likely timely. However, it is unclear from the limited facts to know for sure. Colorado law provides a three-day cancellation period for “home solicitation sales” that are signed in one’s home or away from the contractor’s permanent place of business. If your mother’s situation doesn’t fall into “home solicitation sales,” then she would only have the cancellation rights included in the contract.

To strengthen her position, I recommend she promptly send a clear written cancellation by mail to the contractor’s address listed in the contract, if she has not already done so—especially if she is still within the three-business-day cancellation period. She should keep copies of the contract, her cancellation email, the mailed notice, proof of mailing, and all sales materials or messages. She should also request the return of any deposit or payment she made.

The claimed $9,000 discount may be important if the contractor’s statement that she had to sign immediately to receive it was false or misleading. Please preserve any advertisements, estimates, texts, or notes relating to that offer. If you'd like to discuss the matter further, you can schedule a consultation with me or one of our litigation attorneys on our website or give us a call at 303-688-0944.
