Robinson & Henry Managing Partner and Real Estate Attorney Don Eby was interviewed by ABC 7 News after a man received a warning from his landlord saying that he would be evicted if he was caught smoking marijuana in his apartment again. Don had this to say about the situation:
"The constitutional amendment specifically says that landlords do not have to allow tenants to possess or use medical marijuana or marijuana for recreational purposes. Because the tenant signed this part of his lease, he agreed not to use marijuana in his apartment. This is a very common problem and a very misunderstood area of the law. The landlord would need proof for these claims to hold up in court though. Do they have pictures? Do they have videos? Do they have other neighbors that are willing to testify?"
