Fox 31 reported about a pregnant and disabled mother who was given 60 days to get out of her apartment after she complained to local management about mice. The pregnant mom was notified that her lease had been canceled and would not be renewed.

The Denver news station reached out to R&H Managing Partner Don Eby to find out what rights tenants’ have in these circumstances.

Don explained to Fox 31, “[The rights include] not having to live with pests, a property must have a working lockable door, [and] it can’t have broken windows,” Don said.

After the property management company’s corporate headquarters investigated the situation, the company terminated the onsite employee who sent the notice. Also, the notice to move out was canceled.

Don added that employees who work for property management companies should expect serious ramifications if they don’t follow Colorado tenant laws.

“That company may terminate that property manager or take other employment action against that individual for exceeding their authority or acting outside of the rules,” said Don.

A landlord has a duty to maintain a habitable property. When they don’t, a tenant may have a legal reason to withhold rent. If you’re a landlord, know the law. Check out our legal guide to find out what makes a rental unit unfit to live in
