Car crashes are an unfortunately common occurrence, and even a seemingly minor collision can result in serious injuries. While obeying traffic rules and regulations and following standard safety practices behind the wheel can help reduce your risk of being involved in an accident, you cannot control the actions of your fellow motorists.

In this article, our reckless driving lawyers discuss what types of driving accidents are considered reckless driving in Colorado.

Car accidents and injuries caused by reckless drivers are a very real danger for Colorado residents. In order to protect yourself and your loved ones, it is important to be aware of the types of dangerous driving behaviors that can lead to potentially life-threatening accidents, as well as what you should do in the event you or someone you love is injured.

Common Types of Reckless Driving

According to car accident statistics from the National Highway Traffic Safety Administration (NHTSA), more than two million people are injured each year in car accidents in the U.S., while as many as 32,000 people die as the result of their injuries. While road, traffic, and weather conditions may be to blame for some of these accidents, more than two-thirds are the result of reckless and dangerous driving behaviors on the part of other drivers. The NHTSA lists the following as being among the most common causes of car accidents and injuries:

  • Driving under the influence of alcohol or drugs, including prescriptions and over-the-counter medications;
  • Speeding, or going too fast for conditions;
  • Distracted driving, such as using cell phones, texting, or engaging in any activity that diverts your attention from the road in front of you;
  • Drowsy driving, which includes driving while excessively tired as well as falling asleep behind the wheel.

Other types of reckless driving behaviors include running red lights or stop signs and aggressive driving behaviors, such as tailgating and failing to yield.

What to Do if You are Injured in a Car Accident

Under Section 42:07 of the Colorado Motor Vehicle Statutes, engaging in any type of behavior that shows a willful or wanton disregard for the safety of other drivers is considered reckless. Drivers who engage in this type of conduct can be held liable for any injuries they cause to other drivers, either through an insurance company claim or by filing a personal injury lawsuit. If you are involved in an accident with a reckless driver, it is important to do the following:

  • Alert your local police or highway patrol, and remain on the scene until they arrive;
  • Exchange information with other drivers, including your driver’s license, vehicle registration, and insurance information;
  • Get medical care immediately for any injuries you suffer, even if your symptoms appear minor;
  • Report the accident to your insurance company as soon as possible.

In the aftermath of your accident, you will likely be contacted by an insurance company representative. Be aware that any statements you make can be used against you to either deny or undervalue your claim. Before speaking with the insurance company or signing any documents, contact our car accident attorney first to ensure your rights are protected.
