Hi, I’ve recently had my house mold tested and it was positive. I have a tenant in the basement where the mold exists and am having a company remediate the mold. My tenant has six months remaining on his lease. I have moved him to a hotel today. May I legally terminate his lease and offer him moving expenses so that I can take care of the mold problem or do I need to buy out the remainder of his lease.

You likely have a right to terminate the lease based on the habitability statute. But, you'll need to process this very strictly according to the rules. If you need assistance you can schedule a free case assessment 24/7 by calling 303-688-0944 or online at https://calendly.com/case-assessment/case-assessment. At your appointment, we'll meet by phone or video (Zoom), we'll discuss your concerns, desired results, rights, remedies, the law, the process, timeline, how we can help, costs, etc.
