question iconWe purchased a home that was built in 1979. The boundary lines have been in place since the home was built. The survey the previous owner did had the stakes and the corners of our current lot. The new home owners next to us just did a survey and are requiring us to move our driveway. The only thing we have done since we moved in to the boundary line is secure the driveway with some boulders.

Often, surveys can be deceptive as to the true boundaries between properties, especially properties that have existed for a long period of time. In Colorado, the doctrine of Adverse Possession is recognized and often applies to driveways, landscaping and walls and fences that have remained in place for at least 18 years. Additionally, driveways are often the result of an easement which must be respected by the owners of a neighboring property.
