question iconOur HOA Covenants, that have not been revised since about 1993, prohibit overnight parking by homeowners on our streets. Some of those streets are public. As I browse around for information on this, I find multiple statements that suggest that HOAs may not enforce on public streets, yet the HOA argues that it can and will fine homeowners who park on the public streets, or whose guests do so. Which is it?

This is a common dispute between owners and overbearing HOAs. In general the city or owner of the street has parking authority. But, that does not mean that the HOA is completely powerless.
