Your Legal Questions Answered

question iconMy neighbor built a makeshift carport in his driveway. However, he included a gutter that extends and dumps into my yard. It has no cap on the end, just jagged metal and could injure someone walking on my property. I asked him 10 days ago to keep it off my property. He has yet to move it and is actively avoiding my husband and I. Am I legally allowed to cut it back to his side of the fence? Am I legally liable if someone gets injured by the gutter on my property?

Your neighbor does not have a right to trespass onto your property. However, before you initiate self-help I recommend that you have a conversation with one of our attorney's RE your rights, remedies, risks, option, etc. You can schedule a case assessment 24/7 by calling 303-688-0944 or online at https://calendly.com/case-assessment/case-assessment. At your appointment, we'll meet by phone or video (Zoom).
