Is a company’s sales non-compete clause legit if the sales rep begins own business in the same field?
If the non-compete has not been signed in “x” amount of years?
If the company has changed names and owners since the first clause was signed?
If the sales rep has no trade secrets, just customer contacts?
It depends on a number of factors, not least of which is the governing law for the non-compete. Additionally, even if the governing law of the non-compete is Colorado law, employees living in certain states such as California may have additional rights provided under that state’s law.
