There is an association on the property that I own (30 homes), it has been loosely organized for many years, unregistered, and at least 1 home paying a different set of fees than the rest of us. They are restarting their organization and attempting to act “as if” they have things in order and organized. They do not follow their bi-laws. 1 of the properties contains multiplie buildings but is a business and considered “1 home” for voting purposes, the association pays maintenance and access fees to this business. When we purchased our home there is nothing noted in the title/deed that there is an HOA

2 Main Questions: 1. What type of activity creates a mandatory vs voluntary HOA? Financial activity, dues collection, meetings, etc. At what point does a lack of transparency and following of guidelines eliminate their ability to operate as a mandatory HOA. 2. We are not a legal subdivision, is there a way for a group of homes that is not legally a subdivision to be considered an HOA?
