question iconIs there a timeline for requesting a refund from a contractor for subpar work? The work in question was done almost two years ago, and my concerns were dismissed by the contractor. I have since hired another company to replace the poor workmanship from the first. But I’m wondering if I should reach out to the first to ask for a refund, or if it’s too late?

Although you can ask for a refund any time, from a legal standpoint the question is when does the statute of limitations preclude a legal action to recover your damages. This determination must be made based on the claims you bring. For example, a tort, breach of contract (oral or written), or fraud claim all can have different limitation periods. This time period is further complicated based on when the event giving rise to the claim could or should have been discovered, among other factors.

So some, but not all, of your claims may or may not be limited. It is therefore absolutely critical to contact an attorney ASAP. Only by understanding the potential claims that can be brought based on your unique facts can an attorney advise you which claims are still available.
