Your Legal Questions Answered

question iconIs subcontractor or contractor liable for material extra material cost in project to finish project

The answer to the question depends on the contract you signed with your contractor. If the agreement specifies that the contractor is responsible for providing all necessary materials to complete the project, then they would likely be liable for any extra material costs. This would be more typical in a fixed rate bid.  However, if the agreement specifies that the owner is responsible for providing materials, then the contractor may not be liable for extra material costs related to those materials. This is more typical in a cost-plus contract.  If you still have questions please contact us at (303) 688-0944 to discuss your situation in more detail during a case assessment with one of our attorneys.
