question iconMy HOA has voted to buy water rights for the common areas, which includes several small lakes. This is very expensive, over $700K and the way the charter is drawn up. Can the HOA force members to spend this amount of money, which doesn’t involve construction, maintenance, etc at all, just water rights. Some of the HOA members have a financial stake in the company that currently owns the water rights, and they stand to benefit, trying to rush this through with the price continually increasing. The vote to proceed with this transaction was by less than 20 of the 160 residents. Number one, do they have the authority to purchase water rights and then demand others pay for it, and number two, is there criminal activity here?
