Our landlord rented how house to two separate tenants, one in the basement one up stairs. Apparently the HOA does not allow that and is going to force the landlord to evict one of the tenants. Is that legal among the pandemic. Can the HOA punish the Landlord for not evicting a tenant when legally (as I understand) they are unable to because the pandemic

The HOA has the right (and the obligation) to enforce the HOA rules. The eviction moratorium is generally misunderstood to prevent all evictions, but that is not true. The moratorium only prevents (most) evictions when the reason for the eviction is failure to pay rent.
