Generally yes, HOAs and their subcommittees are required to follow Colorado's Property line and fence laws for shared fences just like any other private land owner. The only difference is that when funding the new build, or repair of a fence, the HOA is a non-profit that exists by collecting dues from its members. As a result, the time needed to obtain the funding is taken into consideration anytime an HOA has to pay its share for erecting or repairing a shared fence.
