My wife of 18 years passed away over a year ago and I am trying to refinance the house into my name. The title company did something that is causing me to do a probate (we are both on the title) but there is no will and we/she have no children. It was just us and my son from my previous marriage who is now married and lives elsewhere. How do I know if this is an informal or formal process?

Most probates in Colorado can be done informally, however, we could not answer the question in your case without more information. Regardless, I doubt you need to file a probate. Houses, particularly those with joint ownership, can typically be passed without a probate saving time, money, and aggregation. If you would like to discuss in more detail, call us at (303) 688-0944.
