question iconAfter reviewing documents about Conservator abuse I am more than sure that I am dealing with one. She has maligned my family, secreted financial dealings, refuses to let son in law even visit, ignores the will of the respondent and also ignores written directives from third party reports. She has hired 6 lawyers and not one was for the respondents benefit it was all to squash the rebuttal of a heir and to refuse the heirs family access to mom. The conservator has totally ignored the fact that the respondent has better care available at a lower cost. The nursing home the respondent was put into is tops in written deficiencies for the state of Massachusetts and this fact was ignored by the conservator. The conservator refused to rent a vacation home the respondent owned for a loss to the estate of over $40,000 then shows up in court and used bogus numbers to the court to show that the home could not support itself when in fact the home was proven to be appreciating by 10% annually and had the potential to produce two to three percent income from renting. The house was sold out of a trust that was executed to stop from happening what happened. Mom had a 4 million dollar estate in 2016 now we are down to 1.5 million and she is housed where she did not want to be according to her will, and her main caregivers that the respondent chose when of sound mind are removed from her life. The conservator says that the respondents chosen caregiver can visit her mom in her room or a small section of the home or as I call it a hallway. Since the conservator has been appointed my family has been refused the ability to even take mom to church or out for anything. The caring heir is treated like a criminal when she visits the respondent. This has been going on for 5 years and we have a capricious judge that believes everything the conservator says and nothing that the caring heirs claim even though the heirs claims come with corroboration while the conservator statements are only accusatory with no evidence to back their claims. We have already been through bankruptcy due to this case and it is much worse than can be said in a paragraph or two.

It sounds like a difficult time. Your best course of action is to speak with a lawyer to discuss your options and evaluate your case. I could not tell from your post whether the conservatorship is in Colorado or Massachusetts. If the case is in Colorado, you can schedule a case assessment with one of our conservatorship attorneys by calling us at (303) 688-0944. Otherwise, you need to contact a lawyer in Massachusetts. It's important to recognize that any claim you have may be barred by the passage of time, so please contact a lawyer as soon as possible.
