question iconEarly yesterday morning my car was towed between 12 a.m. and 6 a.m. from the two parking spots I own in front of my townhome. After four calls, Collins Towing stated they had my 2014 Nissan Sentra in their lot, and that my HOA Board had requested my car to be towed for “double parking.” In contacting my HOA, they recognized my car should not have been towed, and covered the towing fees; however, I’m feeling targeted by the Board in allowing my car to be towed without explanation now for the second time in five years.

It is not okay for an HOA to target individual homeowners and enforce the rules more stringently against the targeted party than other homeowners. If you wish to bring a suit against the HOA you should discuss the specific claims, likelihood of success, process, timeline, potential costs and damages, with an attorney. Robinson and Henry attorneys have a lot of experience in representing homeowners against HOAs, we can help.
