What you describe could potentially be viewed as workplace harassment or intimidation, and you may have a claim for relief under both Colorado and federal employment laws.

In an employment law context, this kind of behavior can create a hostile work environment, which is a form of workplace harassment that's prohibited by both federal and Colorado law. We wrote an entire article on hostile work environments that you may find interesting.

In summary, a hostile work environment is a work environment that is characterized by discrimination, harassment, or other offensive behavior. This type of an environment can lead to a number of negative consequences for employees, including mental and emotional distress, decreased productivity, increased absenteeism, and increased turnover.

In Colorado, assault is defined as willfully threatening or attempting to inflict an injury. In the civil context (money damages) this is know as an intentional tort. Even if you were not physically harmed, the act of pounding on your vehicle's window could possibly be interpreted as a threat of bodily harm.

I would recommend speaking to your Human Resources Department about the incident. To determine if you have a case, we would need you to contact us so we can gather more information for our employment law team to fully evaluate your claim. Feel free to contact us at (303) 688-0944.
