question iconMy son is incarcerated and gave power of attorney to his girlfriend so that she could put money in his account at the El Paso County jail. He was receiving approximately $150 a month from VA benefits. The VA approved a backpay settlement and it came to over $10,000. The girlfriend started taking money at a fast rate for unknown and unauthorized reasons. He was in the process of changing the Power of Attorney to me, his mother. I live in Indiana which has made this extremely difficulty. He has since been moved on 2 occasions and has not had the opportunity to get the new POA notarized. The bank is not allowing me to freeze the account. What was once over $10,000 she has dwindled to around $4,000. What can we do to stop her. I think she might also have sold his vehicle and bought another in her name.

This is a very serious problem. There are a couple of avenues to protect your son's money and to recover from the girlfriend if she is indeed abusing her authority by stealing from your son.
