question iconGood afternoon, I recently received a tax liability stating that I owe taxes from 2018. When I called the IRS regarding this the stated that I owed for a 1099. The mlm company that I was in only for a few months, falsely stated that I made 6948.00 when in actuality I made 17.00. I have reached out to the company by phone on 1/7/21 and the customer service representative confirmed that I only made 17.00 and they dont send 1099 forms to reps that make under 600. She stated that she made notes and would forward to the CEO. What can I do? The IRS is expecting me to pay next week? Thanks, Shaneka Johnson

Shaneka, as you know, when a company files a 1099, it is reported to the IRS. This type of filing is called an information return. You’ve taken the best course of action, which is to contact the company to have the 1099 corrected. I would continue to call back until someone in management reviews the matter. You need the company to send a corrected 1099 to the IRS and to give you a copy of the corrected 1099. If that does not work, you will have to prove to the IRS that you did not receive those funds, which can be difficult. Also, you may have recourse to sue the company for improperly filing a 1099 for the amount that you were damaged. You will want to review any contract you have with the company to determine where to bring the lawsuit. Good luck!
