Denver’s Fox31 News asked Robinson & Henry what are tenants’ rights if a building’s heat goes out? At an older apartment in Denver, the boiler stopped working. Residents were given space heaters but it came with restrictions. They couldn’t use any other appliances when the space heater was on due to the building’s older electrical system.
Attorney Christopher "Kit" Davlin told Fox31 renters have a right to live in a safe, clean, and healthy environment.
“Landlords have an obligation to meet the Warrant of Habitability in Colorado. That’s implicit in every lease you will sign,” Kit said. “It doesn’t have to happen within the hour or necessarily in the day, but when you’re talking about something like heat in a state like Colorado, that’s important. That is an absolute necessity.”
Kit added that landlords have a specified timeframe, according to the lease, for making repairs.
Colorado landlords must follow the state’s strict laws. Any deviation creates the risk for a lawsuit.
