Living at The Grand Apartments was anything but grand. Residents at the luxury apartment building experienced flooding because of poorly installed pipes from the initial construction. The landlord alleged the flooding was a “catastrophe” to justify vacating the entire building to begin repairs. 

Then, The Grand didn’t renew some of its leases and asked others to leave before their leases expired. Two sets of tenants reached out to Robinson & Henry when their landlord sued them for remaining in their apartments after being served with eviction notices.

Attorney Christopher "Kit" Davlin told Denver7 The Grand believed the wording in the leases entitled them to evict tenants based on a “catastrophe.” 

“They made an argument that these were catastrophic circumstances that allowed them to evict anyone,” Kit said.

Kit, a Senior Associate at Robinson and Henry, underscored that his clients’ units were not directly impacted amid the continuous flooding.

"The apartments were still habitable, but The Grand was planning in the future to create a situation that might make them uninhabitable that might be a catastrophe, but that hadn't actually happened," Kit said.

“‘Catastrophe’ is a specific thing that has to happen; it's when the apartment burns down or when there's a chemical spill, and everybody has to get out right now," Kit explained. “Our clients were able to stay for a significant period of time, right up through the lawsuit. So no catastrophe had happened. The Grand was simply arguing that one might or would happen in the future, when they had to do their own repairs.”

Kit helped both sets of clients prevail in court. When it was time to schedule a damages hearing, The Grand quickly reached a confidential settlement with our clients
