You can always fire your contractor. The question is, if you fire them, are you in breach of contract? Or can you contend that you’re firing your contractor because your contractor is the one that is actually in breach? That becomes a factual question that comes down to the contract itself and comes down to the specific breach alleged. I would recommend contacting an attorney to discuss what types of damages you may face if you wrongfully fire your contractor. Or even discuss what would be the proper method to terminate your relationship with your contractor to protect yourself from being sued for damages by your contractor alleging that you were actually the one in breach.
