In Texas, you are legally married until your divorce is finalized. During the period of physical separation (whether or not the spouses are living together) you can ask the court for Temporary Orders, that will award temporary child support, spousal support and a visitation schedule if there are children. This is the closest you can come to a "legal separation" which does not exist in Texas Family Code.
