I am an 80yr (low income) woman and have good credit, yet live SS to SS payment in my home that I own (yet still making payments). I was involved in an parking lot car accident where a minor injury turned into a death of another older person. The criminal phase is over, yet the deceased lawyers have now filed a claim for ~$400k for wrongful death. Can I (or should I) file for Chapter 7 now to protect my home (I am within the homestead limit) or do I need to wait for the lawyers to actually file the lawsuit?See answer

We purchased a tiny home from a company and paid in full a little less than 20k in Jan 2021, we were provided updates overtime that they were building the house and sending us pictures and updates and it was custom made to our design specs. We were waiting on them to finish getting a RV certification but they said they finished our home and were going to deliver it, then suddenly we were ghosted and never heard from them again when we attempted to inquire about the certification and delivery until they mailed a bankruptcy letter. Later we saw on their youtube channel that they had sold our custom house for $45,000 more than double what they sold it to us for, but they never told us they were selling it nor offered us any kind of refund on the money we had paid for the custom tiny home. After they had already sold the home then they decided to file Chapter 11 bankruptcy months later and so we were unable to get our original money invested back nor the tiny home we purchased. Would this case qualify for a Deceptive sales practices lawsuit or a criminal case? We are not the only ones they scammed but we are one of maybe 2 or 3 people who they took money from and who actually had houses they had finished like ours and were sold out from under them prior to them filing bankruptcy with no notification that they were going to try and sell or any refund given. Most people they took money from they hadn't started building the houses yet so there wasn't a complete product, unlike ours. Is there anything we can do? Since they sold our house prior to the filing of bankruptcy?See answer

QUESTION 1: Do you accept clients who are private individuals trying to collect a debt from another private individual? And if so, may I inquire as to your rates and whether you employ paralegals on small, simple cases so as to defray costs as much as possible? BACKGROUND: In rather exigent circumstances, I loaned my brother $12,537.90 at a 12% annualized rate of interest. He signed a Promissory Note to that effect on July 20, 2016. The final payment should have been made on March 1, 2018, but during the entire scheduled period of planned amortized payments, he made NONE. He did thereafter subsequently make three small payments, the last of which was made on April 30, 2018. QUESTION 2: Will the original 6-year statute of limitations on a personal loan run out on: 1) July 20, 2022 (6 years after he signed the Promissory Note) 2) March 1, 2024 (calculated from the final scheduled unpaid payment due date of March 1, 2018), or 3) April 30, 2024 (6 years after he made his last payment on April 30, 2018)? (I'm pretty sure it's #3, but please confirm.)See answer
