We have kids. Who decides parenting time – us or a judge?
Who decides parenting time for you in your case is largely going to depend on if you’re in a settlement agreement or if we’re going towards a contested litigation in front of the judge. If you have the ability to settle with your spouse or your partner with regards to the children, you are making those decisions. The court largely will review the decisions to make sure that they are in the best interest of the children, but you’ve made them. If you are not able to agree and you’re in a contested litigation situation, you will present arguments to the judge, and ultimately the judge is the one that’s going to make the decision with regards to the children.
