My husband and I own a home under both of our names. If I moved out, would I lose any rights I have to the home?

This is a common question. The answer is typically no. I can think of certain circumstances why you might not want to move out, but concern over an equitable division of the value of a marital asset is not one of them. Remember that either sale or refinance of the related mortgage will likely be needed and deadlines for those events are necessary. These transactions are complicated and some experience and foresight regarding potential pitfalls will be helpful.
