You can. In fact, someone will have to buy the other’s interest unless you and your spouse want to try to continue to own it jointly as simple business partners. The buy out process depends heavily on the kind of business, it’s potential value and the level of detail the agreement will need to make sure that the business transfer takes place in an organized and complete fashion. Oftentimes we use independent and jointly retained CPA’s to assist with valuation of the business interests for purposes of allocation within the dissolution of marriage.
