It is a scary thought that one’s spouse might be hiding assets in a divorce process. That is not only unfair but also a violation of the rules and law associated with dissolution of marriage in Colorado. In Order to demonstrate that assets are hidden, we often issue what we call “formal discovery” which includes questions and requests for specific kinds of documents, like account statements, payroll records, etc. which could help us discern how much is being received and how much is being spent or transferred out of the marital accounts. Sometimes discerning whether income is being hidden we have to rely on how much is being spent from the same bank account and credit card records. There is really no simple answer to this question and it bears scheduling a meeting with a lawyer to discuss the underlying facts which lead you to the conclusion that money is being inappropriately dissipated from the marital estate.
