Because the taxpayer is responsible for the tax liability and preparing the tax return properly, you cannot avoid liability to the IRS based on TurboTax's failure to flag your S.S. withholding. If you are penalized, you may be able to make a reasonable cause argument based on the TurboTax issue, or avoid penalties base on first-time penalty relief....

A 1099 is an informational return filed with the IRS. It appears the company may have filed a corrected 1099-C. As you can see, a corrected filing is allowed on the form. https://www.irs.gov/pub/irs-pdf/f1099c.pdf. I would suggest contacting your CPA to discuss how to handle the correction and if an amendment to your return is appropriate.

Unfortunately, we do not currently handle that type of matter, and I suggest you contact another lawyer to evaluate your claim. The Colorado Bar Association maintains a list of licensed Colorado lawye...

Shaneka, as you know, when a company files a 1099, it is reported to the IRS. This type of filing is called an information return. You’ve taken the best course of action, which is to contact the company to have the 1099 corrected. I would continue to call back until someone in management reviews the matter. If you fail to report the amount, or otherwise address it, you will receive an ...

You may amend your tax returns any time that you would like. A claim for a refund, however, must be filed within 3 years from the time the return was filed or 2 years from the time the tax was paid (whichever is later). if you amend your tax return and the amount of income reported does not match the amount reported on the 1099, then the IRS may de...

I would not recommend issuing a 1099 in the name of someone that did not do the work for a number of reasons, not least of which is that it could be problematic to you in the case of an audit by the IRS or Department of Labor. Likewise, if you give her a gift (she did not do any work after all), why would you still not owe the person that did the w...
