Good morning everyone. My name is Robert Harper, I’m a litigation attorney here at Robinson & Henry. One of my areas at this law firm is going to be personal injury. I wanted to do a quick little video, as far as how insurance companies value car accident claims.
Three Basic Pillars to Every Case
First I wanted to go over the three basic principles, what I like to call the three basic pillars of every single case:
Now, those three basic principles are how every insurance company will value a claim.
Who Was at Fault?
So, let’s start off with liability. So, liability is basically how they’re gonna say, how they’re gonna look at how the accident occurred.
Obviously, if you were rear ended, Colorado assumes that the other person is at fault. So, if you were rear ended, that’s pretty much a non-issue right then and there.
How Did You Get Your Injuries?
Next, is gonna be causation. This is where the insurance company is gonna look at property damage, primarily. So, if you have a dent in your bumper, they will potentially question how could you have been injured in a rear end, if there’s a dent in the bumper?
If your back end is smashed, generally that’s gonna be a more stronger claim for causation, and the accident causing your injuries.
Get Treatment & Document Your Injuries
The most important principle that I’d like to go over, is going to be injuries. I’ve seen too many people come in to my office, saying that they were injured, but they don’t think that they need medical treatment.
That’s a big problem, because if you say that you were injured, but you don’t have the medical treatment to support those injuries as documentation, generally the insurance companies will value your case at little, if anything at all.
